Justice for victims of Medical Negligence

As the name of our Trust itself screams, we are an NGO primarily dedicated to patients’ welfare.

The Trust attempts to raise the voice of victims of gross medical negligence at various levels and to support them in their plight for justice on pro-bono basis.

The Trust strives to sensitize the medical fraternity towards patients’ care with human approach.

Our Mission

At the very outset, the Trust expresses utmost gratitude to the doctors in general who have been doing noble service for the alleviation of the pain and sufferings of the patients.

The Objects of the Trust include, amongst others, the following : -

  • To strive for Patients’ Welfare

  • To enlighten the Patients about their Rights

  • To sensitize the medical fraternity towards patients’ care with human approach

  • To attempt to raise the voice of victims of gross medical negligence at various levels

Rajesh Kumar Sharma , the Managing Trustee , is an Advocate at the Hon’ble Supreme Court of India.

Abheesht Sharma is an Engineer by profession and is the founder Trustee of the Trust.

Yathesht Sharma is a Chartered Accountant by profession and is the founder Trustee.

The Hon’ble Supreme Court of India, vide its judgment in the case of Jacob Mathew Vs. State of Punjab and Another, (2005) 6 SCC 1, directed the Government of India and/ or the State Governments to frame Statutory Rules or Executive Instructions incorporating certain guidelines in consultation with the Medical Council of India (now National Medical Commission).

The nation has since been waiting for more than 20 years for the said Statutory Rules or Executive Instructions to be framed by the Government of India but the same are yet to be framed and notified even after two decades of the Jacob Mathew Judgment passed in the year 2005.

‘SAMEEKSHA FOUNDATION - A Crusade Against Medical Negligence’ has under the circumstances filed a Public Interest Litigation (PIL) before the Hon’ble Supreme Court of India. The Hon’ble Supreme Court has been pleased to issue notice to Govt. Of India and National Medical Commission vide Order dated 01.12.2025.
